All customers are required to accept the following Terms of Use to use our hosting services.

Internet Etiquette - You are expected to execute reasonable Internet etiquette (Netiquette), the accepted behavior and expectations of the Internet community. We reserves the right to refuse or terminate service at any time for violation of this section. This includes advertising services or sites via IRC or USENET in clear violation of the policies of the IRC channel or USENET group.

Abuse Toward Host.ac Staff - Host.ac treats it's clients with respect. As such, we expect the same respect in return. Abuse toward Host.ac staff is not tolerated to any extent. The use of threats, vulgar language and/or obscenities is not acceptable. Host.ac reserves the right to Terminate Client Services for abuse and the right to determine when to apply said Termination. No refund will be provided under these terms.

Spam - Spam is strictly prohibited on our servers. We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account terminated without notice or refund. Spamming includes: sending advertisements to multiple e-mail addresses at a time, spamming Host.ac and using forced attacks via e-mail. We have zero stance policy on SPAM, Junk E-mail or UCE. Spam, Junk-mail and UCE are defined as: the sending of the same, or substantially similar, unsolicited electronic mail messages, whether commercial or not, to more than one recipient. A message is considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. UCE also includes e-mail with forged headers, compromised mail server relays, and false contact information. This prohibition extends to the sending of unsolicited mass mailings from another service, which in any way implicates the use of us whether or not the message actually originated from our server. Host.ac reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. Host.ac also reserves the right to make any such modifications in an emergency at our sole discretion. Host.ac reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Host.ac. XXX Websites - Adult websites are not allowed on our servers.

Illegal Downloads - This includes the use of Warez, Mp3s, Cracking, copyrighted software that you do not have permission to use.

Copyright Infringement - Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or other intellectual property rights; including creating, utilizing, distributing unauthorized copies of software, or the use of BitTorrent or other types of technologies utilized in the distribution of illegally copied materials. If customer copies, distributes or installs software in defiance of the license agreement, customer is violating federal copyright law. We will cooperate with all law enforcement agencies in relation to alleged copyright infringement housed in our datacenters.

Account Data Loss - All users are responsible for their own data. We do keep accurate data files such as MySQL files at hand but if those files appear to be corrupted, you are responsible for all data on your website. So make sure you frequently back-up your files.

Viruses - Hosting viruses is strictly prohibibited. If you want to host this type of material do not do it here. This includes: Hosting Viruses, Sending Viruses via e-mail, and allowing users to download files with trojans, viruses, or other harmful files.

Misuse of Resources - Including but not limited to employing applications which consume excessive CPU time. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and as such is not allowed. CGI based message forums are often found to use excessive system resources and are not allowed, to avoid problems please use a PHP/ASP message forum.
- Users may not use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP e.t.c.
- Users may not run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
- Users may not run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
- Users may not run any software that interfaces with an IRC (Internet Relay Chat) network.
- Users may not run any bit torrent.
- Users may not host or distribute any form of media files such as mp3, mpg, wmv, rm, avi e.t.c. This is strictly prohibited by our network provider.
- Users may not run any gaming servers such as counter-strike, half-life, battlefield1492 e.t.c.

Web Space Usage - The space on your hosting account is for you to use. Make sure you monitor your website constantly if you allow ftp access to your site for uploading. You are responsible for any file located on your site. If we detect you are hosting something illegal or is in violation of this Terms Of Use, we will suspend you account until future investigation is made.

Bandwidth Usage - You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

Hosting Policy - Data Unlawful or Against the Terms of Service: Promoting violation of the law or the Terms of Use by hosting data that facilitates the violation is prohibited, including but not limited to:
- Hosting web pages that detail the methodology of committing unlawful acts, or acts violating this Terms of Use.
- Deceptive marketing practices.
- Actions that restrict or inhibit anyone - whether a customer of Host.ac or otherwise - in his or her use or enjoyment of Host.ac's products and services, or that generate excessive network traffic through the use of automated or manual routines that are not related to ordinary personal or business use of Internet services.
- Hosting software, scripts, or other resources intended to facilitate committing unlawful acts, or acts violating this Terms of Use.
- Advertising, transmitting, storing, or using any software, script, program, product, or service designed to violate this Terms of Use.
- Harvesting. The collection of email addresses, credit card information, or other personal information for fraudulent use or sale is prohibited.
- Phishing. Hosting web pages with forwards to, containing scripts or executables for, or any other component of an operation designed to fraudulently collect authentication, credit card, names, addresses, or any other personal data (“phishing”) is not permitted.
- Spamvertised Sites. Hosting web pages advertised by spam sent from another network (“spamvertised”) is not permitted.
- Causing or attempting to cause security breaches or disruptions of Internet communications. Examples of security breaches include but are not limited to accessing data of which the customer is not an intended recipient, or logging into a server or account that the customer is not expressly authorized to access. Examples of disruptions include but are not limited to port scans, flood pings, packet spoofing and forged routing information. This also includes no IRC on the network.
- Executing any form of network monitoring that will intercept data not intended for the customer.
- Circumventing user authentication or security of any host, network or account.
- Furnishing false or incorrect data on the order form contract (electronic or paper) including fraudulent use of credit card numbers or attempting to circumvent or alter the processes or procedures to measure time, bandwidth utilization or other methods to document "use" of Host.ac's products or services.
- Harassment, whether through language, frequency, or size of messages.
- Unauthorized use or forging of mail header information.
- Solicitations of mail or any other E-mail address other than that of the poster's account or service, with the intent to harass or collect replies.
- Creating or forwarding "chain letters" or other "pyramid schemes" of any type.
- Exporting, re-exporting, or permitting downloads of any content in violation of the export or import laws of the United States or without all required approvals, licenses and exemptions.

Some Other Restricted Websites - We also do not accept websites of the following content:
- HYIP, Investment Websites
- PPC - Pay Per Click
- Pay Per Search
- Auto Surf
- Lottery
- Gambling

Violation of the Terms of Use - Violation of the Terms of Use will result in immediate suspension and/or termination of account without notice.

Service Rates - Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to Subscriber. Subscriber is aware that the Company may prospectively change the specified rates and charges from time to time. The promotional offer is contingent upon Company achieving and maintaining its cost of service goals including but not limited to rates charged to company by its suppliers.

Payments - You agree to pay for hosting services rendered in advance of each monthly service term. Non-Payment of services shall result in automatic suspension of your hosting account. If you fail to secure payment within 30 days of suspension, your account will incur termination (removed permanently from server). Host.ac reserves the right to change the monthly payment amount and any other charges at anytime.

Cancellation and Refunds - Host.ac reserves the right to cancel the account at any time. Customers may cancel at any time. Host.ac gives you an unconditional 30 day money back guarantee on all hosting accounts. You will be refunded the total amount you had paid minus the payment processing fee charged by the payment gateway for your payment. Refund requests after 30 days will not be honored. Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

Indemnification - Customer agrees that it shall defend, indemnify, save and hold Host.ac harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Host.ac, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Host.ac against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Host.ac; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Host.ac's server.

Disclaimer - Host.ac will not be responsible for any damages your business may suffer. Host.ac makes no warranties of any kind, expressed or implied for services we provide. Host.ac disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Host.ac and its employees.

Changes to the Terms - Host.ac reserves the right to revise its policies at any time without notice.
